In 2011, the United States government labeled law firms the "soft underbelly" of corporate security. People have come to understand that a law firm's network and data storage systems routinely contain sensitive files from multiple major corporations. Unauthorized access can yield a treasure trove of strategic, financial and intellectual property information across a wide cross section of industries. Ransomware is forecast to become a $1 billion business in the upcoming year. Law firm managers must understand where the holes are in a typical law firm's cybersecurity strategy and evolving technical solutions for securing a law firm's most valuable asset – information. Recent cyberattacks on law firms also have raised awareness of lawyers' ethical duties to protect their client's confidences.
Objectives:
Analyze the law firm cyberthreat.
Discuss technologies to combat the cyberthreat
Identify the IP lawyers' ethical duties regarding cybersecurity and breaches.
~ This session fulfills the minimum of 1 hour in business Ethics required for CLM Recertification

Today's IP professionals are faced with increased demands to maximize efficiency, value, and competitive advantages. Highly repeatable processes – such as preparing patent or trademark applications, processing and reporting prosecution notices or incoming foreign associate correspondence, and payment of government fees – by definition, contain a series of repeatable, describable steps. As such, they are particularly well suited for improvement projects using Lean and Six Sigma methodologies and tools.
Attendees will get an introduction to key process improvement methodologies, such as Lean Six Sigma and project management and how they apply not just to legal work but to intellectual property practice. Plus there will be an opportunity to try mapping a process of greatest interest to you (and your table team.) You'll bring back relevant ideas and skills that will help take you and your firm to the next level.
Objectives:
Examine and analyze what other law firms and legal departments are doing.
Identify key process improvement methodologies and the stages of project management.
Explain how process improvement and project management work together in IP-specific processes to deliver significant returns on investment.
Assess how process improvement tools can identify and communicate best practices in IP work.
Determine how to promote and maintain a client-centric focus, where internal and external customer requirements and functions are identified, analyzed and tied to process improvement in a continuous improvement culture.
Audience: Attendees should have at least 10 years of experience in legal industry operations. No advance preparation is required.

Intellectual property is well known for being one of the riskiest of all legal practice areas. Managers of law firms that provide patent and trademark litigation, prosecution and opinion services must be ever vigilant in ensuring their firm's practices and procedures are designed to minimize the risks that firm members will violate their professional duties to clients and the bar. This session will focus on the "Four Cs" of ethics duties that frequently arise in the context of IP-related misconduct: competence, conflicts, confidentiality and candor. We will address the nature of those risks, how they can be identified, and best practices for individual lawyers and firm management for avoiding common ethical and malpractice pitfalls in an IP practice setting.
Objectives:
Identify recurrent ethics issues in IP practice.
Demonstrate the organization's role in mitigating IP practice risk.
Develop best practices for managing IP firm ethics risks.

Sophisticated law offices use historical data and real-time analysis to determine the value of work. Metrics known prior to preparing client quotes or request for proposals (RFP) are key elements of success. Once work for a client is underway, unexpected changes in the scope of the work require a special talent for identifying what steps may be taken to put a case back on track. This session will dig into the metrics for three intellectual property (IP) case studies as a basis for understanding key principles for margins and profitability. Attendees should have read the published case studies prior to the session and have a working knowledge of law firm profitability and financial management. These case studies will be emailed to you before the conference.
Objectives:
Identify how the scope of IP work defines and limits law firm profitability.
Discuss the metrics involved in specific IP cases and how changing variables limit or increase profitability.
Review whether a law office is operating at the same level of sophistication as its clients.
Develop an understanding of why some clients are no longer interested in "alternative billing" and prefer custom billing designed for their situation.
Audience: This session assumes that participants have a working knowledge of Law Firm Profitability and Financial Management and have read the published case studies sent to them prior to the conference.

The increasing frequency of lateral movement of lawyers poses sometimes difficult issues that must be addressed by law firms and the affected lawyers. Each party to a lateral move — the lawyer's existing firm, the lawyer's new firm and the individual lawyer — face different issues and challenges. Objectives:
Analyze the issues faced during a lateral move and the potential for the new firm to become embroiled in a dispute with the prior firm.
Identify best practices that can be adopted by law firms bringing in lateral attorneys.
Discuss best practices that can be adopted by law firms regarding the departure of attorneys.
Audience: This session assumes that participants have a working knowledge of risk management and staff planning in a legal environment.
